After four years of "roof rights protection" the owner finally won the case! Tesla is sentenced to hand over data

Recently, the People's Court of Daxing District of Beijing made a first-instance judgment on the sale contract dispute between Ms. Zhang v Tesla Auto Sales Service (Beijing) Co., Ltd. and others, and determined that Tesla, as an operator, has the obligation to protect consumers' right to know, and ordered it to provide Ms. Zhang with complete driving data half an hour before the accident.

Ms. Zhang said that the judgment confirms the fact that Tesla failed to comply with the administrative orders of the State Administration for Market Regulation and did not provide driving data in full four years ago. She questioned whether there was effective punishment for such car companies that blatantly violated state administrative instructions, and bluntly said, "Can Tesla really do whatever it wants?"

  In an interview, Ms. Zhang said that the judgment was an industry milestone, "can be said to be the first case in the industry." The court clearly confirmed the legitimate rights and interests of smart car consumers in data acquisition for the first time. She said it was "a very meaningful thing" to be able to get such a judgment.

Ms. Zhang also revealed that she has joined multiple groups of smart car rights protection car owners, each group with a size of about 200 people, and no one has successfully obtained the complete data of her own vehicles so far. After the news of the first instance victory came out, multiple rights protection groups responded enthusiastically and the car owners were excited.

At present, she is the only case among many rights protection car owners that have obtained the support of the court. The judgment clearly confirmed that the data provided by Tesla previously was incomplete and confirmed that consumers have the right to obtain complete driving data. Next, after obtaining the complete driving data, she will apply for judicial appraisal based on this to determine whether the Tesla vehicle involved in the accident did have "brake failure".

  It is understood that Ms. Zhang is the party involved in the "roof rights protection" incident at the 2021 Shanghai Auto Show. Since her father's rear-end collision in February 2021 and was found fully responsible by the traffic police, she has continued to question the accident caused by "braking failure" and has repeatedly asked Tesla for complete driving data but failed. On April 19 of the same year, she boarded the roof of the Tesla show during the Shanghai Auto Show and shouted "Tesla's brake failure", which aroused widespread public attention. She was then sentenced to five days of administrative detention by the Shanghai police on the grounds of disrupting public order.
